A new conformation is presented regarding the evaluation of administrative
contracts in function of defects in their formation or defects in supervening, determinants of the initiation of process of invalidation, forfeiture or cancellation of the contract, with the weighting criteria determined for the specific case, by means of application of principles defined in the standard, in addition to undetermined concepts that lead to the discretion of the public agent. The control of the judiciary over administrative decisions is facilitated by the existence of indicators and used by the public agent in the evaluation of contracts, as such indicators provide the formation of guidelines to guide decisions according to the field of activity and the types of contracts signed.
