Abstract

This study aims to deepen the understanding of women’s persistent struggle
against domestic violence and the consequent withdrawal from work through the National Institute of Social Security (INSS). The analysis addresses the complex issue of gender-based violence in a historical and social context marked by the prevalence of patriarchy and sexism, factors that historically led to male domination and the subjugation of women. The stereotyped image of women as fragile, vulnerable, and inferior has contributed to making them the primary targets of violent acts, a reality that unfortunately persists to this day. In this sense, it is crucial to delve into the historical past to comprehend the current situation and outline perspectives for the future. The methodology adopted in this study involves a comprehensive literature review, allowing for a thorough and in-depth analysis of the subject. Furthermore, special attention will be devoted to examining jurisprudence as guidance for understanding the guarantee and protection of women’s rights, given the alarming statistics of domestic violence and gender-related homicides. Therefore, through this research, we seek to contribute to a more comprehensive and informed understanding of the causes and impacts of domestic violence against women, as well as to highlight the importance of legal and social strategies for the protection and promotion of women’s fundamental rights in our society.
