Abstract

This is a study aimed at analyzing the film “O vento will be your inheritance”
from the perspective of due process in the democratic state of law, especially with regard to the constitutional guarantees that are guaranteed in the Constitution of the Federative Republic of Brazil. It is important to demonstrate that by providing citizens with this very important guarantee that is capable of protecting them against any arbitrariness by the State and other individuals, mentioning a guarantee received by the 1988 Constitution, in article 5, item LIV, in the chapter on rights and individual guarantees, the guarantee of due process of law. “By the principle of due process of law, any imposition that affects the freedom or assets of a person must be subject to the scrutiny of the Judiciary, which will act through a natural judge, in an adversarial process that ensures the parties ample defense. ”. Thus, it demonstrates through the film The wind will be your inheritance the arbitrariness and injustice that can occur when the basic principles of a judicial process are not observed.
